Account Creation :   To access certain services, such as project management tools and order history, creating an account may be necessary. You are responsible for providing accurate and up-to-date information during registration and maintaining the confidentiality of your account credentials.

Intellectual Property

Our Content :   All materials on this website, including text, graphics, logos, and design elements (collectively, the "Content"), are owned by or licensed to Design & App. This Content is protected by copyright and other intellectual property laws.

Your Content :   You retain all ownership rights to the original content you submit to us for creation (your "Content"). However, by submitting your Content, you grant Design & App a non-exclusive, royalty-free license to use your Content solely to fulfill your service request. This includes the right to copy, edit, modify, publish, and distribute your Content as part of your completed requirement..

This Refund Policy outlines the circumstances under which Design & App may offer a refund for its services.

1. Eligibility for Refunds

Refunds are generally not available for services rendered. However, we understand that unforeseen circumstances may arise. Design & App may consider a partial refund on a case-by-case basis for the following reasons:

  • Project cancellation by client :   If you choose to cancel your project before we begin working on it, you may be eligible for a full refund, minus a non-refundable processing fee of the total project cost.

  • Significant Deviation from Project Specifications :    In the unlikely event that the delivered work deviates significantly from the agreed-upon project specifications, as outlined in the project proposal, and we are unable to rectify the issue to your satisfaction within a reasonable timeframe, a partial refund may be offered.

2. Refund Exclusions

Refunds will not be granted for the following reasons:

  • Dissatisfaction with the style or tone of the task, as this is subjective and reflects creative choices made in consultation with the client.
  • Request for revisions exceeding the scope of the originally agreed-upon project, as outlined in the project proposal.
  • Delays caused by the client's failure to provide necessary information or feedback promptly.
  • Work completed according to project specifications but not used by the client for any reason.

3. Refund Request Process

To request a refund, please contact us at info@designnapp.com. Your request should clearly state the reason for requesting a refund and any relevant details supporting your claim.

4. Refund Timeline

If your refund request is approved, you will receive the refunded amount within 10-15 business days via the original payment method used for the purchase.

5. We Reserve the Right to Refuse Refunds

Design & App reserves the right to refuse a refund request at its sole discretion, particularly in cases where the request is deemed frivolous, unreasonable, or violates these Terms & Conditions.

Disclaimers and Limitations of Liability

Disclaimer of Warranties :   Design & App strives to provide high-quality services, but we cannot guarantee that our services will be uninterrupted, completely secure, or error-free. The services are provided "as is" and "as available" for your use.

Limitation of Liability :   To the fullest extent permitted by law, Design & App shall not be liable for any indirect, incidental, special, consequential, or exemplary damages (including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses) arising out of or relating to your use of the service, even if Design & App has been advised of the possibility of such damages.

Governing Law and Dispute Resolution

Governing Law :   These Terms & Conditions and any separate agreements entered into for the provision of our services shall be governed by and construed per the laws of the State of Texas, United States of America.

Dispute Resolution :   In the event of a dispute arising out of or relating to these Terms & Conditions or your use of our services, the parties agree to attempt to resolve the dispute through informal negotiations. If informal negotiations are unsuccessful, the dispute shall be resolved by binding arbitration by the rules of the American Arbitration Association ("AAA") and held in Irving, Texas.

Indemnification

You agree to indemnify, defend, and hold harmless Design & App, its partners, agents, affiliates, and employees (collectively, the "Indemnified Parties") from any claims, demands, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your breach of these Terms & Conditions or any documents incorporated by reference herein.
  • Your violation of any applicable law or regulation.
  • Your infringement or violation of the rights of any third party.

User Conduct
